Jiveworld, SPC, a California social purpose corporation, operates the www.jiveworld.com, www.jiveworld.app and www.lupa.app websites and subdomains, and the Jiveworld and Lupa branded browser-based and mobile applications. Together, these constitute our “Service” — the provision of digital language-learning tools based on the Jiveworld Method.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

HOW WE COLLECT & USE INFORMATION

Types of Data Collected

Personal Data
While using our Service, we may ask you to provide certain personally identifiable information that can be used to contact you or authenticate your account ("Personal Data"). Such data currently include first name and email address (for general users of our Service) and institution name (for educators using our Service in the classroom).

We collect this minimal amount of information for the sole purpose of providing our Service to you, including the sending of certain transactional or other mandatory emails for account management purposes, and periodic communications regarding product updates and new features. You may opt out of any newsletters or marketing materials at any time by following the unsubscribe link at the bottom of any email we send. Teachers who sign up for an educator’s account may receive a one-time welcome email from us.

If you purchase any premium content offered by our Service, the payment processors (Apple, Google Pay, Stripe) may ask you to provide additional Personal Data, including full name, address, zip code, and payment information. These payment processors adhere to the standards set by PCI-DSS, as managed by the PCI Security Standards Council, to ensure the secure handling of payment information. Such information is not stored on our servers, and its safeguarding is governed by the respective policies of Apple, Google, and Stripe.

Usage Data
Usage Data is data collected automatically either from the use of the Service or from the Service infrastructure itself. This Usage Data may include information that your device sends when you visit our site(s) or access our Service via a mobile device, such as your device’s Internet Protocol (IP) address, device type, operating system version, browser type, browser version, the web pages that you visit, the date and time of your visit, time spent on those pages, unique device identifiers and other diagnostic data.

Classroom Usage Data
We collect Usage Data from licensed users who are students in a classroom offered via our Service, which include progress on class assignments, and the utilization of certain features (e.g. saving vocabulary) associated with language learning.

We use or may use the data collected to:

  • Monitor and maintain our Service
  • Communicate account and billing information with you
  • Allow you to participate in interactive features of our Service

  • Analyze usage so we can improve our Service

  • For Classroom Usage Data only: Allow educators with classrooms set up via our Service to monitor the progress of their students

HOW WE SHARE YOUR INFORMATION

Jiveworld, SPC only shares personal and usage data with third parties in a few limited circumstances, as described below. We do not rent or sell information to third parties for marketing or other purposes.

  • We may share Usage Data with providers of technology services (e.g. web hosting and analytics services), strictly for the purpose of carrying out their work for us.
  • We may be required to share personal information with law enforcement or other third parties when compelled to do so by court order or other legal process, to comply with statutes or regulations, to enforce our Terms of Service, or if we believe in good faith that the disclosure is necessary to protect the rights, property or personal safety of our users.

If we sell, divest or transfer our business, we will not transfer Personal Data of our users unless the new owner intends to maintain and provide the Service as a going concern, and provided that the new owner has agreed to data privacy standards no less stringent than our own. HOW WE STORE & PROTECT YOUR INFORMATION

Storage & Processing

Any information collected on Jiveworld, SPC’s servers is stored and processed in the United States. If you access our Service from outside of the United States, you consent to have your data transferred to the United States.

Keeping Information Safe

Jiveworld, SPC abides by the Center for Internet Security's Critical Security Controls cybersecurity framework. We maintain strict administrative, technical and physical procedures to protect information stored on our cloud-hosted servers, which are located in the United States. Access to information is limited to only those employees who require it to perform their job functions. We use industry-standard Secure Socket Layer (SSL) encryption technology to safeguard the user registration process. Other security safeguards include, but are not limited to, data encryption and firewalls.

DATA RETENTION

Following the closing of a user account, we will de-identify Personal Data by removing unique identifiers. We may retain de-identified profile information and content for a reasonable time for backup, archival, research, or audit purposes.

We may also retain Usage Data for internal analysis purposes, to strengthen the security or improve the functionality of our Service, or if we are legally obligated to retain this data.

CHILDREN’S PRIVACY

Jiveworld, SPC’s products and services are not designed for children under the age of 13. We do not market to or knowingly collect personally identifiable information from such children.
